This Constitution outlines the WHF and its functionality
within the world handcycling movement.

CHAPTER I -
IDENTITY- PURPOSE |
|
Article 1 |
|
1.1 |
The WHF is the association of National Handcycling
Federations. |
|
1.2 |
The WHF is an international non-political and a
non-profit organisation. |
|
1.3 |
The registered headquarters of the WHF is 43
Yarnolds Shurdington Cheltenham, Gloucestershire GL51
45J United Kingdom.
|
|
1.4 |
The WHF, Continental and National Federations shall
follow the same Rules, Regulations and Guidelines. |
|
Article 2 |
|
2.1 |
The purposes of the WHF are: |
|
|
a |
To direct, develop, control and regulate handcycling
worldwide. |
|
|
b |
To promote Handcycling internationally. |
|
|
c |
To organise global Handcycling events and the WHF
World Championships. |
|
|
d |
To promote sportsmanship and fair play. |
|
|
e |
To represent Handcycling and defend its interests at
all national and international authorities. |
|
2.2 |
Founding Principles |
|
|
a |
The WHF will carry out its activities in accordance
with the principles of:
-
equality between all the members and all the
athletes; and
-
equality between licence-holders, and officials,
without racial, sexual, political or religious prejudice,
for disabled and non disabled people.
|
|
|
b |
The WHF is an independent association, but
cooperates with other organisations to further the aims
and development of the WHF. |
|
|
c |
The WHF is open to all nations and athletes who
accept the Rules, Regulations and Guidelines of the WHF. |
|
|
d |
National races are open to all athletes abiding by
the Rules, Regulations and Guidelines of the WHF. |
|
|
e |
The World Handcycling Federation furthers innovation
in:
-
Equipment modifications and new technologies;
-
Generating new events; and
-
Rules and classifications.

Article 3 |
|
3.1 |
The Founding Principles (2.2) cannot be repealed.
The Rules of the WHF can be amended. The European
Handbike Circuit forms the statutory framework of the
WHF. |
|
CHAPTER II - MEMBERS |
|
Article 4 |
|
4.1 |
The members of the WHF shall be the National
Federations accepted by the Executive Committee of WHF
(“the Federation”). |
|
Article 5 |
|
5.1 |
Only one Federation shall be admitted to membership
of the WHF per country. |
|
Article 6 |
|
6.1 |
The Federations shall comply with the Constitution
and Rules of the WHF, including all decisions made by
the WHF. |
|
6.2 |
The Rules of the WHF shall be incorporated into the
corresponding rules and regulations of the Federations. |
|
6.3 |
The Constitution and Regulations of the Federations
shall not be inconsistent with the Constitution and
Regulations of the WHF. |
|
6.4 |
The WHF Executive Committee must be informed where
the constitution of the Continental or National
Federation diverges from the WHF Constitution. |
|
Article 7 |
|
7.1 |
Applications for membership of a Federation shall be
signed by the representatives of the National Federation
and sent to the registered Headquarters of the WHF (“the
Application”) |
|
7.2 |
The Application must be accompanied by a bound
document containing the following: |
|
|
a |
A written statement that the applicant federation
shall accept, apply and comply with the WHF Constitution
and Regulations, and adapt its own constitution and
regulations as a condition of their admission; |
|
|
b |
The text of the constitution and all regulations of
the applicant federation; |
|
|
c |
A detailed report on the structures and activities
for handcycling of the applicant federation; |
|
|
d |
A list of organisations to which the applicant
federation is already affiliated; |
|
|
e |
The composition of the management committee or
equivalent body; |
|
|
f |
The official address for correspondence; and |
|
|
g |
The identity of persons authorised to sign
correspondence. |
|
7.3 |
The Application for membership and its annexes shall
be prepared in English. |
|
7.4 |
The Federations shall inform the WHF in writing, of
any changes to the criteria in paragraph 7.2 above as
soon as possible. |
|
Article 8 |
|
8.1 |
Applications for membership shall be
reviewed by the Continental Committees. |
|
8.2 |
Before submission to the Executive Committee, the
Continental Committee may request additional information
from an applicant Federation. |
|
8.3 |
The Continental Committee may require the applicant
Federation to alter its structure or regulations so they
conform with the Founding Principles in paragraph 2.2,
and the Regulations of the WHF before submission to the
Executive Committee. |
|
Article 9 |
|
9.1 |
If the Application for membership is
deemed complete and conforms with WHF Rules, Regulations
and Guidelines, the Continental Committee shall inform
the National Federation in writing, and place the voting
on admission in the agenda of the next executive
committee meeting. |
|
Article 10 |
|
10.1 |
The Executive Committee of WHF shall decide on the
admission of a Federation to the WHF before voting on
any other item of the agenda of the meeting, with the
exception of voting on the expulsion of a Federation. |
|
10.2 |
An applicant federation may make a presentation
before the Executive Committee. The applicant
federation’s delegates must leave the room when the
application is being reviewed and a vote taken. |
|
Article 11 |
|
11.1 |
A Continental or National Federation shall not join
a competing organisation or a body declared as such by
the Executive Committee, without the prior written
approval of the Executive Committee. |
|
|
a |
If a Continental or National Federaijoins, or
continues to be a member of a competing organisation or
a body declared as such by the Executive Committee, the
Executive Committee shall serve a notice of intention to
suspend the membership of the Continental or National
Federation with the WHF if they fail to withdraw their
membership with the competing organisation, to their
registered address immediately. |
|
|
b |
A Continental or National Federation that does not,
within one month of the receipt of the notice, comply
with same, shall be automatically suspended from the WHF.
Article 12 |
|
Article 12 |
|
12.1 |
Failure of a Federation to fulfil any of its
obligations pursuant to the Constitution and Regulations
of the WHF shall render the Federation liable to a fine
to be decided by the Executive Committee. The Executive
Committee may delegate this power. |
|
12.2 |
In the event of serious or persistent breach, the
Federation concerned may be expelled. |
|
12.3 |
A serious breach is a breach that: |
|
|
a |
Brings the WHF into disrepute; |
|
|
b |
Involves actions that are inconsistent with the
Founding Principles of the WHF; or |
|
|
c |
Is a breach of this Constitution. |
|
Article 13 |
|
13.1 |
Each Federation shall pay an annual membership
contribution (“the Contribution”), the amount of which
shall be fixed by the Congress. |
|
Article 14 |
|
14.1 |
The first Contribution is due for the calendar year
in which the Federation is admitted to the WHF. |
|
Article 15 |
|
15.1 |
The Contributions are collected on behalf of the
WHF by the respective Continental Federations. |
|
15.2 |
The Continental Federations shall remit to the WHF
before the 30th of June of each year an amount equal to
one third of the total contributions, due by their
respective Federations. |
|
Article 16 |
|
16.1 |
At the request of the Continental Federation
concerned, the WHF Executive Committee shall place on
the agenda of the next congress the suspension of a
National Federation that has failed to pay the
Contribution. |
|
Article 17 |
|
17.1 |
The suspension of a Federation entails the
following: |
|
|
a |
Inadmissibility of the nominations of its affiliates
for elections; |
|
|
b |
Suspension of the members of the Federation in
committees and commissionsof the WHF; |
|
|
c |
Deletion or non-registration of its races in the
international calendar; |
|
|
d |
Exclusion of the Federation’s cyclists from world
championship and international events; or |
|
|
e |
Refusal or withdrawal from the organisation of world
championship events. |
|
17.2 |
In the interest of third parties, the Executive
Committee may determine that: |
|
|
a |
paragraph 17.1 will not be applied; or |
|
|
b |
paragraph 17.1 will only be applied for a period of
time to be determined by the Executive Committee.
|
|
Article 18 |
|
18.1 |
A Federation may be excluded by the Executive
Committee in the following cases: |
|
|
a |
When the Federation is under suspension during the
Management Meeting; and |
|
|
b |
When the Federation discredits the international
reputation of WHF handcycling. |
|
18.2 |
The decision to exclude a Federation requires a
majority of two thirds at Executive Committee level. |
|
18.3 |
The Executive Committee shall decide on the
expulsion before voting on any other point on the
agenda. |
|
Article 19 |
|
19.1 |
A Federation shall be given a reasonable
opportunity to be heard before a sanction is imposed on
it. |
|
Article 20 |
|
20.1 |
A Federation wishing to leave the WHF shall give
written notice of resignation by registered post to the
registered headquarters of the WHF. |
|
Article 21 |
|
21.1 |
Under no circumstance will a Federation be entitled
to reimbursement of its membership contributions. |
|
21.2 |
The office bearers of the WHF shall not be liable
for any act, error or omission in carrying out their
duties as officers or members of the WHF except in the
case of fraud, criminal conduct or dishonesty. |
|
21.3 |
The WHF will indemnify and keep indemnified the
officers for all liability to the Federations or to any
third party for all acts, errors and omissions performed
by them in carrying out their duties, save in the case
of fraud, criminal conduct or dishonesty, |
|
CHAPTER III -
CONTINENTAL FEDERATIONS |
|
Article 22 |
|
22.1 |
Federations from the same continent shall be
grouped together in a Continental Federation, and will
become an integral part of the WHF. |
|
22.2 |
There shall be 5 Continental Federations: |
|
|
a |
Africa; |
|
|
b |
America; |
|
|
c |
Asia (including Middle East); |
|
|
d |
Europe; and |
|
|
e |
Oceania. |
|
22.3 |
Each Federation shall belong to the Continental
Federation in which geographical region the country
lies. Exceptions to this may be decided by the Executive
Committee with the absolute majority of the votes cast
upon a request made to the Management Committee by the
Federation and both Continental Federations concerned. |
|
Article 23 |
|
23.1 |
The Continental Federations shall promote the
continental development of Handcycling in the WHF
framework and in accordance with local practice. The
Continental Federations shall inform the WHF of any
specific Handcycling requirements for their continent. |
|
23.2 |
The Continental Federations shall submit to the
Continental Committee of the WHF proposals for
activities at the continental level in particular: |
|
|
a |
Preparing the continental calendar of Handcycling
events; |
|
|
b |
Organising and planning the training courses for
commissaires, technicians, athletes, basic trainers and
coaches; and |
|
|
c |
Organising continental championships or regional
games. |
|
23.3 |
The Continental Federation President shall prepare
the regulations for the organisation of continental
handcycling activities with the Executive Committee. |
|
Article 24 |
|
24.1 |
Each Continental Federation shall be organised to
ensure the proper execution of their tasks in the
operation of the WHF. This will be through: |
|
|
a |
At least one general meeting of the Federations
every year; and |
|
|
b |
A President and management election every two years. |
|
24.2 |
The election of the President and the Executive
Committee shall take place between 1 October and 31
October preceding the year in which the WHF Executive
Committee is elected. |
|
24.3 |
The Continental Federations will inform the WHF, in
writing, of the identity of the President as the
continental representative within one week of the
election. |
|
24.4 |
The Executive Committee of the WHF can establish
standard rules of procedure for the Continental
Federations. |
|
Article 25 |
|
25.1 |
Regulations and decisions of the Continental
Federations may be cancelled by the Executive Committee
of the WHF where the Regulations and decisions of the
Continental Federations are inconsistent with the
Constitution and Regulations of the WHF. |
|
CHAPTER IV -
ANNUAL CONGRESS |
|
Article 26 |
|
26.1 |
The WHF Annual Congress is the general meeting of
the WHF. |
|
26.2 |
The WHF Annual Congress shall include: |
|
|
a |
The WHF President and two (2) WHF Vice Presidents; |
|
|
b |
The Steering Committee of the WHF; |
|
|
c |
The Continental Federation Presidents and
Vice-Presidents; |
|
|
d |
The WHF Secretary, Treasurer, Chairman and
Vice-Chairman of the Honorary Board; and |
|
|
e |
The independent representatives of the WHF. |
|
Article 27 |
|
27.1 |
The Annual Congress shall be held annually. |
|
Article 28 |
|
28.1 |
The Annual Congress may contain the following
topics: |
|
|
a |
Alteration of the Constitution and dissolution of
the WHF; |
|
|
b |
Admission, expulsion and suspension of Federations; |
|
|
c |
Setting the annual amount of contributions on a
proposal of the Executive Committee; |
|
|
d |
Dismissals of the members of the Executive Committee; |
|
|
e |
Elections of the President and two (2) Vice
Presidents and the other members of the Executive
Committee; |
|
|
f |
Appointment of the Honorary Board and Appeals Board,
on a proposal of the Executive Committee; |
|
|
g |
Appointment of the public auditor, on a proposal of
the Honorary Board); |
|
|
h |
Reports of the treasurer, the Honorary Board and the
public auditor; |
|
|
i |
During the Congress, the E.C. shall report on its
management. To this end, the E.C. shall draw up a
report, approval of which by the Congress shall amount
to discharge for its management; |
|
|
j |
The annual account of the previous year and the
budget of the following year; |
|
|
k |
Actions from Executive Committee; |
|
|
l |
Honours; |
|
|
m |
Long-term strategies; |
|
|
n |
Proposals; and |
|
|
o |
Continental and national feedback. |
|
Article 29 |
|
29.1 |
Notice convening the Annual Congress shall be sent
to the Continental Federations at least ninety days
before the date of the Meeting. The notice shall
indicate the date, time, and location of the Meeting and
the agenda. Proposals, if any, to be heard at the
meeting will be provided in full text. |
|
Article 30 |
|
30.1 |
The Annual Congress agenda shall be prepared by the
Executive Committee. |
|
30.2 |
A Federation wishing to include one or more items
on the agenda of the Congress, or to put a question to
the Executive Committee, shall submit the draft
proposals stating the reasons on which they are based or
the text of its question, in English, to the registered
headquarters of the WHF at least ninety (90) days before
the date of the Meeting. |
|
30.3 |
With the exception of alterations to the
Constitution, any question not on the agenda of the
Congress may be added to be discussed and voted on by
the Meeting at the request of half, or more of the
present Federations. |
|
30.4 |
Subject to paragraph 30.3, no vote shall be taken
on any question not on the agenda. |
|
Article 31 |
|
31.1 |
Each continental delegation of the WHF is
represented by their President and Vice-President. |
|
31.2 |
Members of the WHF staff and Athletes without any
management officiate may not be appointed as delegates
to the Congress. |
|
Article 32 |
|
32.1 |
Unless otherwise decided by the Annual Congress,
the meetings of the WHF shall not be made public. |
|
Article 33 |
|
33.1 |
The Chairman/Vice Chairman of the WHF Executive
Committee shall open and chair the Congress. The
Chairman/Vice Chairman shall read the agenda and conduct
the discussions and voting operations. |
|
Article 34 |
|
34.1 |
Before proceeding to vote on the items of the
agenda, the members of each delegation may address the
Congress and speak freely on the item put to vote. |
|
34.2 |
The Congress management meaking time
of each delegate and the number of speakers to one per
delegation. |
|
34.3 |
The Chairman shall close the discussions unless the
Congress decides otherwise. |
|
CHAPTER V -
WHF EXECUTIVE COMMITTEE (the “EC”) |
|
Article 35 |
|
35.1 |
The WHF shall be managed by the EC under the
authority of the Congress. |
|
35.2 |
The WHF EC shall be composed of 11 members with a
maximum of 11 votes: |
|
|
a |
the President and two (2) Vice Presidents of the WHF; |
|
|
b |
the presidents or vice presidents of the Continental
Federations; |
|
|
c |
the Chairman or Vice Chairman of the Honorary Board;
and |
|
|
d |
the Secretary and the Treasurer (four of the 11
members are directly elected by the Congress). |
|
35.3 |
In the case of absence of the continental
presidents or of the chairman of the Honorary Board
their substitutes are entitled to vote. |
|
35.4 |
The chairman of the EC shall also be the President
of the WHF. |
|
35.5 |
In the event of a member of the EC holding more
than one position, they are only entitled to one vote. |
|
Article 37 |
|
37.1 |
All proposals that fail to obtain an absolute
majority of the votes cast shall be rejected. In the
event of a tie, the proposal shall be re-heard and a
second vote conducted. |
|
37.2 |
Following a second round vote, if there is still a
tie, the President shall have the deciding vote. |
|
37.3 |
If the voting pertains to more than two outcomes,
neither of which obtained absolute majority, a second
round of voting shall be organised on the two outcomes
with the best score in the first round. |
|
37.4 |
A majority of two thirds of the votes cast shall be
required in the following cases: |
|
|
a |
Expulsion of a member; |
|
|
b |
Dissolution of the WHF; and |
|
|
c |
Amendment of the Constitution. |
|
However, the dispositions of Articles 22, 35, 37, 44,
and 45 of the present. Constitution cannot be amended
except by a majority of three quarters of the votes
cast. |
|
37.5 |
Absentee, null and void votes shall not be included. |
|
Article 39 |
|
39.1 |
The candidates who obtain the largest number of
votes shall be elected. |
|
39.2 |
In the event of an equality of votes, a runoff
election of the tied candidates will be conducted. |
|
Article 40 |
|
40.1 |
The WHF EC meeting may decide that a proposal is to
be submitted to an appointed subcommittee. The appointed
subcommittee shall draft the relative report to the WHF
EC. |
|
40.2 |
The proposal shall be included in the agenda of the
next EC meeting. |
|
Article 41 |
|
41.1 |
Minutes shall be taken at every Meeting of the WHF
and all Federation meetings. |
|
41.2 |
The minutes shall be prepared in English. |
|
Article 42 |
|
42.1 |
Unless otherwise decided by the EC, the decisions
of Meetings shall be effective immediately. |
|
Article 43 |
|
43.1 |
The WHF shall be managed by its EC, the WHF’s
mission and finance will be controlled by the WHF
Honorary Board. |
|
43.2 |
The WHF EC shall be vested with the powers of
management of the WHF and the regulation of Handcycling. |
|
Article 44 |
|
44.1 |
The WHF Executive Committee will: |
|
|
a |
Fix the date and venue of the EC meeting; |
|
|
b |
Convene and be responsible for organising the EC
Meeting; |
|
|
c |
Execute the decisions of the meetings; |
|
|
d |
Propose the nomination of the members of the Appeals
Board and the auditor; |
|
|
e |
Propose the amount of annual contribution to the
Congress; |
|
|
f |
Decide the budgets and the annual accounts; |
|
|
g |
Nominate the members of the WHF Honorary Board; |
|
|
h |
Appoint the Treasurer and Secretary of the WHF; |
|
|
i |
Decide on contracts to be entered into with third
parties; |
|
|
j |
Engage staff; |
|
|
k |
Establish its own rules of procedure; |
|
|
l |
Establish the drug test regulations and all other
regulations relating to handcycling in general; |
|
|
m |
Establish and appoint the members of any
subcommittees; |
|
|
n |
Establish the venue and protocol for the WHF World
Championships; and |
|
|
o |
Choose the International Commissaires for the WHF
World Championships. |
|
44.2 |
The WHF EC shall establish the conditions of
participation in World and Continental Handcycling
events. |
|
44.3 |
Infringements to WHF Rules and Regulations shall be
sanctioned in accordance with the regulations and
procedures laid down by the WHF EC. The following
sanctions may be applied: |
|
|
a |
Warning; |
|
|
b |
Reprimand; |
|
|
c |
Fine; |
|
|
d |
Suspension; |
|
|
e |
Final exclusion; |
|
|
f |
Exclusion from one or more specific events; |
|
|
g |
Disqualification from a race; |
|
|
h |
Downgrading; |
|
|
i |
Penalties in time and/or points; or |
|
|
j |
Withdrawal of prizes. |
|
44.4 |
Difficulties concerning the interpretation or
application of the WHF Rules and Regulations shall be
settled by the WHF EC. If necessary, the EC shall be
supported by the WHF Honorary Board and legal department.
The EC may delegate this power. |
|
Article 45 |
|
45.1 |
The WHF EC shall be composed to conform with the
WHF mission and Constitution. |
|
Article 46 |
|
46.1 |
The term of office of the WHF EC shall commence at
the beginning of the new financial year. |
|
46.2 |
The nominated WHF EC members shall be elected every
two years. The outgoing members shall be eligible for
re-election. |
|
Article 47 |
|
47.1 |
The President and two (2) Vice Presidents of the
WHF shall be voted in by secret ballot. |
|
Article 48 |
|
48.1 |
The term of office of a member of the WHF EC shall
end through resignation, death, or dismissal. The
election of a successor of an elected member shall take
place at continental level no later than three months
after the term of office concluded. |
|
Article 49 |
|
49.1 |
The WHF EC shall meet at least twice a year. |
|
49.2 |
The WHF EC shall meet at the written request of: |
|
|
a |
The Chairman of the EC; |
|
|
b |
The Chairman of Honorary board; or |
|
|
c |
Committee members, if at least four members request
a meeting. |
|
|
Where a meeting has been requested, the choice of venue
shall be determined by the EC Chairman. Meetings shall
take place, wherever possible, on the occasion of an
International Handcycling event. |
|
49.3 |
In urgent cases, the Chairman may request a postal
vote. The decision shall be valid if at least two thirds
of the members have cast a vote. |
|
Article 50 |
|
50.1 |
Any member having a personal interest in a matter
submitted for deliberation, must notify the other
members and leave the session before the deliberation. |
|
50.2 |
Where the EC is to deliberate and decide on a
disputed issue concerning a Continental Federation, the
members of the EC with the nationality of this
Federation shall leave the session. |
|
50.3 |
In the case of equal votes, the President shall
have the deciding vote. |
|
Article 51 |
|
51.1 |
Matters within the jurisdiction of the EC may be
allocated between their members. Members may be assisted
in their tasks by a subcommittee chaired by them. |
|
51.2 |
A member assigned responsibility for a specific
matter shall prepare an annual budget for their field of
activity. The budget must be approved by the EC and
shall be incorporated into the general budget of the WHF.
In the case of an extreme urgency, the President and two
(2) Vice Presidents may make the decision alone, and
shall inform the EC of the decisions as soon as possible. |

51.3 |
If the President of the WHF is absent or unable to
attend, the President shall be replaced temporarily by
the EC. In this situation, the EC selects one of the
Vice Presidents to assume the temporary role of
president. |
|
51.4 |
In the event of death, resignation or dismissal of
the President, the Honorary Board Chairman shall fill
the office of President until an election is held by the
EC. |
|
CHAPTER VI -
WHF PRESIDENT |
|
Article 52 |
|
52.1 |
The President and the Vice President are directly
elected by the Congress. The candidate for President is
not required to be a member of the EC. |
|
52.2 |
The President of the WHF shall chair the Congress
of the WHF and the meetings of the EC. |
|
CHAPTER VII -
WHF PERSIDENT AND TWO (2) VICE PRESIDENTS |
|
Article 53 |
|
53.1 |
The urgent business of the WHF shall be considered
by the President and the two (2) Vice-Presidents. |
|
53.2 |
President and the two (2) Vice-Presidents shall not
take part in the voting on items on the agenda, that
concern their Federation or the Federation they hold a
position with, providing only one vote is cast. |
|
CHAPTER VIII -
EXTERNAL REPRESENTATION |
|
Article 54 |
|
54.1 |
The President of the WHF EC shall represent the WHF
in all circumstances. |
|
Article 55 |
|
55.1 |
The WHF shall be validly bound to third parties by
the joint signatures of: |
|
|
a |
The President and Treasurer; |
|
|
b |
The President and a Vice-President; or |
|
|
c |
The President and Honorary Board Chairman. |
|
CHAPTER IX -
SUB-COMMITTEES |
|
Article 56 |
|
56.1 |
The WHF EC shall set up sub-committees it considers
necessary for the proper functioning of the WHF. The EC
shall appoint members of the sub-committee and prescribe
their sphere of activity and function. |
|
CHAPTER X -
ADMINISTRATIVE SERVICE |
|
Article 57 |
|
57.1 |
The administration of the WHF shall be placed under
the direction of the President assisted by a Secretary. |
|
57.2 |
The Secretary shall be appointed by the EC. |
|
57.3 |
The Secretary shall keep the WHF Constitutions and
Rules and Regulations up to date and ensure they are
duly published and distributed to the Federations. |
|
57.4 |
The Administrative Service shall perform the
following duties: |
|
|
a |
The general secretarial services of the WHF; |
|
|
b |
The secretary service of the Appeals Board; |
|
|
c |
Routine bookkeeping; |
|
|
e |
Receipt of payments; and |
|
|
f |
Make authorised payments. |
|
57.5 |
The Administrative Service shall be situated at the
WHF Headquarters Office. |
|
CHAPTER XI -
TREASURER |
|
Article 58 |
|
58.1 |
The WHF EC shall appoint a Treasurer (possibly
under contract), on a proposal of the President and two
(2) Vice Presidents. The Treasurer, where possible,
shall be experienced in financial and tax matters. |

The Treasurer shall carry out their duties under
the supervision of, and in cooperation with the Chairman
of the WHF Executive Committee. The Treasurer shall be
assisted by the Administrative Service of the WHF. |
|
58.3 |
The duties of the Treasurer shall include: |
|
|
a |
Preparing the WHF budget and Annual Accounts; |
|
|
b |
Examining the financial and taxation implications of
all contracts entered into by the WHF and report to the
WHF EC on the implications of same; |
|
|
c |
Control all revenues and expenditures incurred by
the WHF; and |
|
|
d |
Financial powers delegated by the WHF EC. |
|
Article 59 |
|
59.1 |
The financial year of the WHF will commence on 1
February and close on 31 January. |
|
59.2 |
The resources of the WHF shall include: |
|
|
a |
Contributions of the Federations; |
|
|
b |
Fees of licence-holders; and |
|
|
c |
Sponsorship and royalties generated by Handcycling
events. |
|
59.3 |
All the monetary values indicated in the texts and
documents of the WHF shall be in Euros. |
|
59.4 |
An allowance may be granted to a person who, in
exercising their duties as a member of the WHF EC or
sub-committee, expends a considerable amount of their
time. |
|
|
a |
When determining an allowance, the WHF EC must take
into consideration the approved budget and the objective
criteria of the WHF before the allowance is approved. |
|
|
b |
A considerable amount of time is to be determined by
the amount of time a reasonable person would take in the
circumstances as decided by the WHF EC. |
|
59.5 |
Travel and accommodation expenses of the members of
the WHF EC and sub-committees, may be reimbursed by the
WHF. The travel and accommodation expenses must: |
|
|
a |
receive prior approval from the WHF; |
|
|
b |
be incurred as a direct result of performing the
duties as members of the EC and sub-committee; and |
|
|
c |
be reasonable. |
|
CHAPTER XII -
FINANCIAL CONTROL |
|
Article 60 |
|
60.1 |
On a proposal from the WHF Honorary Board, the EC
shall appoint a public auditor for a period of four
years. The term of office shall be terminated
exclusively by the Honorary Board. The Honorary board
shall approve the contract between the auditor and the
WHF. |
|
60.2 |
The auditor shall be appointed one year after the
election of the WHF Executive Committee. |
|
60.3 |
The auditor shall be an independent company
auditor. |
|
60.4 |
The auditor shall audit the accounts of the WHF,
and prepare a relevant report to be submitted to the
Executive Committee and Honorary Board. |
|
CHAPTER XIII -
APPEALS BOARD |
|
Article 61 |
|
61.1 |
An Appeals Board shall be set up consisting of
three members: |
|
|
a |
a Chairman; and |
|
|
b |
two members. |
|
61.2 |
The Congress shall elect the Chairman and two
additional examiners on proposal of the EC. |
|
Article 62 |
|
62.1 |
The Chairman, where possible, shall be the holder
of a recognised university law degree. |
|
62.2 |
The members of the Appeals Board shall be fluent in
English. |
|
62.3 |
The members of the Appeals Board shall hold no
positions in the WHF or a Continental Federation. |
|
Article 63 |
|
63.1 |
The members of the Appeals Board shall be appointed
for a term of four years. |
|
Article 64 |
|
64.1 |
The Appeals Board shall have the jurisdiction over: |
|
|
a |
Appeals in cases provided for in the WHF Rules and
Regulation; |
|
|
b |
Appeals from administrative, sporting and
disciplinary decisions made by the authorities of the
WHF and National Federations; |
|
|
c |
Disputes between the WHF, the Continental
Federations and the Federations; and |
|
|
d |
Disputes referred from interested parties. |
|
64.2 |
The WHF and the Federations shall refrain from
referring disputes (pursuant to Article 64.1 b) to the
State Courts or authorities and shall submit all such
disputes for arbitration to the Appeals Board. |

64.3 |
Decisions of the Appeals Board are final. |
|
Article 65 |
|
65.1 |
The WHF EC shall regulate: |
|
|
a |
The functioning of the Appeals Board; |
|
|
b |
The proceedings in compliance with the rights of the
defence; |
|
|
c |
The expenses of the proceedings and the fees of the
members of the Appeals Board; |
|
|
d |
The decisions of the appeals; and |
|
|
e |
The execution of decisions pronounced by the Appeals
Board. |
|
CHAPTER XIV -
OFFICIAL LANGUAGES |

Article 66 |

66.1 |
The official language of the WHF shall be English. |
|
Article 67 |
|
67.1 |
The WHF Constitution, Rules and Regulations,
minutes, and all documents submitted to the Meetings
shall be prepared in English. |
|
Article 68 |
|
68.1 |
All documents or letters addressed to the WHF shall
be prepared in English. |
|
68.2 |
The language used during the meetings of the WHF
shall be English. |
|
68.3 |
During the meetings, simultaneous interpretation
may be provided in French and German where possible. |
|
CHAPTER XV -
CORPORATE IDENTITY – SYMBOLS, LOGOS & ETHICS |

The use of all WHF logos and symbols are under the
direction of the WHF Executive Committee. |
|
69.2 |
A WHF representative will be assigned with the task
of maintaining the integrity of the WHF corporate
identity. |
|
69.3 |
The WHF EC controls the adherence of the ethical
rules of the organisation. |
|
CHAPTER XVI -
LEGALITIES |
|
Article 70 |
|
70.1 |
The WHF Rules and Regulations established by the
Executive Committee, especially with regards to Drug
Test Regulations, may be referred to the Court of
Arbitration for Sport. |
|
70.2 |
All proceedings against the WHF shall be referred
exclusively to the appropriate jurisdiction where the
registered Headquarters office of the WHF are situated. |
|
CHAPTER XVII -
DISSOLUTION |
|
Article 71 |
|
71.1 |
The WHF shall be established for an indefinite
period. |
|
71.2 |
Dissolution shall only be determined at the Annual
Congress or extraordinary Congress. |
|
71.3 |
The EC shall convene the extraordinary Congress to
deliberate on the possible dissolution of the WHF. |
|
71.4 |
Dissolution shall be decided by a majority of two
thirds of the votes cast. |
|
Article 72 |
|
72.1 |
The Congress shall appoint one or more liquidators
on dissolution of the WHF. |
|
|
|
|
|
|

Any residual funds, after all creditors have been
paid, shall be donated to an international charity. |
|
|
b |
Under no circumstances shall the residual funds be
distributed to the members of the WHF. |
|
72.2 |
At the end of the liquidation process, the
liquidators shall report to the Congress. The Congress
shall then declare the liquidation finalised. |

CHAPTER XVII -
HONORARY BOARD |
|
Article 73 |
|
73.1 |
The Honorary Board is comprised by a Chairman and a
Vice Chairman. |
|
73.2 |
The Honorary Board advises the WHF Executive
Committee. |
|
73.3 |
Legal basis of the work of the Honorary Board forms
the statute of the WHF. |
|
73.4 |
The central task of the Honorary Board is the
consultation and monitoring of the WHF Executive
Committee and its activity. |
|
73.5 |
The Honorary Board has voting rights at the
meetings of the EC. Co-operation between the WHF EC and
the Honorary Board is regulated in the Constitution. |
|
73.6 |
Approved, reasonable maintenance, and personal
travel costs may be subsidised by the WHF. |
|
73.7 |
The Honorary Board proposes the auditor of the WHF. |
|
73.8 |
The Honorary Board must hold at least one meeting
in the financial year. |
|
73.9 |
The Honorary Board may consist of former
Continental Presidents or former members of the WHF
Executive Committee. |

73.10 |
The Honorary Board can create sub-committees to
prepare certain kinds of adoptions of resolutions or
reports for the Annual Congress or WHF EC. |

The Honorary Board shall cite the persons and
bodies who fail to comply with the Constitutions and
Regulations. |
